Terms of use

This document sets out the Terms and Conditions governing the booking of accommodation made available on this website by Vacancéole Voyages.

Please read these terms and conditions carefully before using the website or booking your accommodation.
By visiting our website and/or booking accommodation, you acknowledge that you have read, understood and accept these terms and conditions, and any amendments thereto.

1. Use of the site

The Website and accommodation services offered are intended solely for individuals and legal entities who are seeking accommodation.

By using the Website or booking accommodation through the Website, you guarantee that:

  • You are legally capable of entering into a binding agreement;
  • You are aged 18 or over, are an emancipated minor, or have obtained permission from a parent or legal guardian, and are fully capable and competent to sign up to these Terms and Conditions which shall be legally binding.

2. Amending these Terms and Conditions

Vacancéole Voyages reserves the right to make changes to the Website and these Terms and Conditions at any time, in particular to reflect changes in market conditions that affect our business, technological advances, or changes in applicable law or regulations or the capacity of the Vacancéole Voyages network.

Where Vacancéole Voyages amends these Terms and Conditions, the amended provisions shall take effect once the amended Terms and Conditions are published on the Website. By continuing to use the Website after the amended Terms and Conditions have been published, you will be assumed to have accepted the amended Terms and Conditions. You therefore should – and agree to – reread these Terms and Conditions.

3. Privacy

Vacancéole Voyages places great importance on your privacy andthe Vacancéole Voyages Privacy Policy is assumed to be included within, and to form an integral part of, these Terms and Conditions, with the effect that your use of the Website also constitutes your acceptance of the Vacancéole Voyages Privacy Policy. 4. User and licence restrictions

This Website contains or uses items of content and material, including, but not limited to, written material, information, software, source and/or object code, data, images, videos, music, sound effects, trademarks, text, designs, logos, icons, audio clips, digital downloads, data compilations, patents (collectively the "Content"), which are taken in full or in part from material provided by Vacancéole Voyages and other sources or which are the property of Vacancéole Voyages or its content providers, and may be protected under applicable domestic and international copyright and intellectual property law, as well as other laws, rules and regulations.

You may not modify, copy, duplicate, republish, upload, post, share or distribute in any way any Content without the prior written consent of Vacancéole Voyages.

Vacancéole Voyages prohibits the use of its trademarks, intellectual property, insignia or product names for advertising purposes, to make reference to any product or service or for any other commercial purpose without its prior express written consent. Likewise, Content may not be used without its prior express written consent.

  • You may not delete any reference to copyright, trademarks or any other intellectual property right or reference to authorship contained on the Website or any item of Content.
  • You may not use any Content in a way that might be in breach of the rights hereby granted to you regarding your use of Content.
  • You may not use any data extraction software programme, bot, or similar data collection or extraction tool on the Content, or extract any portion of the Website or the Content, or in any way duplicate, reprint, copy, store, publicly display, disseminate, share, modify, translate, pair, publish, sub-licence, assign, transfer, lease or distribute the Content without Vacancéole Voyages' prior written consent.
  • You may not circumvent any mechanisms in the Content aimed at preventing unauthorised reproduction or distribution of the Content.

5. Acceptable Use

You may only use the Website for lawful purposes.
You may not engage in actions that:

  • violate or infringe upon the rights of Vacancéole Voyages or any third party including, but not limited to, rights pertaining to patents, trademarks, production secrets, copyrights, privacy protections or any other third-party intellectual property or private right;
  • are illegal, threatening, abusive, harassing, defamatory, slanderous, false or misleading, fraudulent, intrusive, an encroachment on privacy, tortious, or which contain explicit or graphic descriptions or accounts of sexual acts or which are obscene/pornographic;
  • victimise, harass, degrade or intimidate an individual or group of individuals on account of their religion, sex, sexual orientation, race, ethnicity, age or disability;
  • mock any individual, company or entity, including Vacancéole Voyages, its employees or representatives;
  • contain viruses or any other computer code, files or programmes that disrupt, destroy or impede the function of any computer software or hardware or telecommunications equipment, or otherwise enable the unauthorised use of a computer or computer network;
  • incite behaviour that might constitute a criminal offence, or result in civil liability;
  • violate these Terms and Conditions or any other instructions or policies published on the Website;
  • are liable to damage, render inoperable, overload or damage the servers and/or networks of Vacancéole Voyages or its webhost or impede the operation, use, and enjoyment of the Website by any other person.

You may not attempt to obtain unauthorised access to the Website or any service, user account, systems or computer networks by way of hacking, password searches or any other unauthorised means; you may not reverse-engineer, decompile or disassemble the Website or any Content therein.

You may not use the Website or any communication tools provided through the Website for the purpose of relaying, directly or indirectly, unsolicited mass communications (including emails and instant messages). You may not gather information about Vacancéole Voyages' users for the purpose of sending or facilitating unsolicited mass communications.

6. Written communications

From time to time, Vacancéole Voyages may be required under applicable law, rules or regulations to communicate with you in writing. By using the Website, you accept that your communications with Vacancéole Voyages will primarily be electronic. Vacancéole Voyages will contact you by email or provide information by publishing notifications on the Website. For contractual purposes, you consent to this mode of communication and acknowledge that all agreements, notifications and other electronic communications that Vacancéole Voyages shares with you comply with all legal requirements under which the communications in question must be in writing.

7. Information available on the Website

Vacancéole Voyages offers no guarantee, and accepts no responsibility in relation to, the genuineness, current relevance, accuracy or completeness of Content. All conclusions that users might draw from information presented on the Website are those of the user and shall not be attributed to Vacancéole Voyages. You accept the need to assess and assume the risks associated with the use of all Content, including the action of establishing that the aforementioned Content is genuine, up-to-date, accurate and/or complete.

8. Your user account

If you create a user account or profile via the Website and you receive the usernames, numbers or codes for identification and/or passwords ("Credentials") in connection with your use of the Website, you agree to ensure that your Credentials are kept strictly confidential and not to share them with anyone.

You are responsible for all improper use of the Website and all Content by any person who uses your Credentials. Consequently, you must take all necessary precautions to ensure that no other person can use, or obtain unauthorised access to, your Credentials.

You must notify Vacancéole Voyages if your Credentials were, or are likely to have been, compromised (i), or you detect any unauthorised use of your Credentials (ii). Vacancéole Voyages may terminate your access to, and use of, the Website with immediate effect and take all necessary legal action against you if you, or any other person using your Credentials, breaches these Terms and Conditions.

You agree to ensure that personal information that you provide is correct, accurate, up-to-date and complete (all of which shall be subject to Vacancéole Voyages' Privacy Policy). Should the information you provide be incorrect, inaccurate, out-of-date or incomplete (or where Vacancéole Voyages has reason to believe that the information provided is incorrect, inaccurate, out-of-date or incomplete), Vacancéole Voyages has the right to remove your Credentials or suspend or terminate your access to, and use of, the Website.

9.  Links

Vacancéole Voyages may position hypertext links on the Website that direct to third-party Websites or content. Vacancéole Voyages has no control over these links or their content, nor third-party content. Your use of these links shall be subject to the respective terms and conditions of use and privacy policy of the websites visited, and not Vacancéole Voyages' Terms and Conditions of Use or Privacy Policy. We therefore encourage you to read them before using or sharing any information with these websites.

10. Limitation of guarantee

Vacancéole Voyages offers a satisfaction guarantee for any Accommodation booked via the Website.

Content available on the website is provided "as-is" with no guarantee of any kind, implicit or explicit. To the furthest extent permitted under applicable law. Vacancéole voyages excludes all guarantees, implicit or explicit, including, but not limited to, in relation to marketability, suitability for a particular purpose and the absence of counterfeiting.

Vacancéole voyages offers no guarantee that the website, the content or any of the website functions shall remain uninterrupted or free from errors, viruses, trojan horses, or other destructve material and other harmful elements, or that any faults will be found and/or rectified.

Vacancéole voyages offers no guarantee, and makes no claims in relation to, the use or consequences of use of the content available on the website or on third-party websites in terms of the genuineness, accuracy, current relevance, reliability or other quality. You (and not vacancéole voyages) are responsible for covering all costs incurred to ensure your access to the website and your use thereof.

Vacancéole voyages expressly accepts no responsibility under the contract, for products and your use of the website in the following instances:

  • Where you engage in fraud or make false or fraudulent declarations; or
  • You intentionally breach the terms and conditions.

11. Limitation of Liability

VACANCÉOLE VOYAGES ACCEPTS NO RESPONSIBILITY FOR DIRECT, INDIRECT, CONSEQUENTIAL OR SPECIAL DAMAGE RESULTING FROM USE OF, OR INABILITY TO USE, THE CONTENT AND/OR WEBSITE. YOU ACKNOWLEDGE AND EXPRESSLY ACCEPT THAT VACANCÉOLE VOYAGES IS NOT RESPONSIBLE FOR THE CONDUCT OF ANY USER. VACANCÉOLE VOYAGES ACCEPTS NO RESPONSIBILITY FOR INDIRECT LOSS RESULTING FROM THE PRINCIPAL LOSS OR DAMAGE, INCLUDING, BUT NOT LIMITED TO, LOSS OF INCOME, TURNOVER, PROFIT OR BUSINESS.

12. Events beyond the control of Vacancéole Voyages

Vacancéole Voyages shall not be held liable if it does not perform, or belatedly performs, any one of its obligations under the Terms and Conditions or under applicable laws, rules and regulations, due to events beyond our reasonable control ("Instance(s) of Force Majeure").

An Instance of Force Majeure is any action, occurrence, non-occurrence, omission or accident beyond our reasonable control, including, but not limited to:

  • Strikes or similar industrial action;
  • Civil unrest, disturbances, invasion, terrorist attacks or the threat thereof, war (declared or otherwise) or imminent or anticipated war;
  • Fires, explosions, storms, flooding, earthquakes, landslides, epidemics or other natural disasters;
  • Stoppages to rail, sea, air, road or other forms of public or private transport;
  • Inaccessibility of public or private telecommunications networks;
  • Laws, decrees, legislation, regulations or restrictions imposed by government.

Vacancéole Voyages' obligations under the Terms and Conditions and under applicable law, rules and regulations shall be deemed suspended for the period over which the Instance of Force Majeure persists. Vacancéole Voyages shall have an extension to the time limit for performance of its obligations during any such period.

13. Indemnity

You agree to defend, indemnify and hold harmless Vacancéole Voyages and its owners, principals, affiliates, licensors and licensees, and their directors, agents, employees, contractors and representatives in respect of all liability, claims, judgements and costs, including lawyers' fees and expert fees, resulting from (i) your use or misuse of the Website; (ii) your breaches of these Terms and Conditions; (iii) your breaches of any law or third-party right, including, but not limited to, any patent, trademark, trade secret, copyright, right to privacy or any other third-party intellectual property right; and/or (iv) all use or misuse of your Credentials.

Vacancéole Voyages shall notify you of the occurrence of an event that might give rise to indemnification. Vacancéole Voyages reserves the right, at its own expense, to take over the defence and exclusive control over any other element that might give rise to indemnification; you shall be required to cooperate with Vacancéole Voyages for the purpose of exploring all available means of recourse in such cases. Such defence and indemnification shall remain valid after termination of these Terms and Conditions and your right to use the Website.

14. Applicable terms and conditions and termination

14.1 Applicable terms and conditions

These Terms and Conditions shall take effect between Vacancéole Voyages and you, when you use the Website for the first time. All amended Terms and Conditions concerning the use of the Website above shall apply as of their publication on the Website.

The Terms and Conditions applicable to accommodation bookings, payment, and all related declarations and guarantees are those in effect on the date on which you placed an order for the Products in question with the relevant order Confirmation, unless a change to these Terms and Conditions is required under applicable law, rules or regulations (in which case the change may apply to your previous orders), or if Vacancéole Voyages notifies you of the change to the Terms and Conditions before Vacancéole Voyages has sent you the relevant Confirmation (in which case you may cancel the order in question if you do not approve the amended Terms and Conditions).

14.2 Termination

If you do not comply with any one of the provisions in these Terms and Conditions or with laws, rules or regulations governing your use of the Website, you accept that Vacancéole Voyages may terminate your Vacancéole Voyages account at any time, with or without notice.

Without prejudice to Vacancéole Voyages' obligations concerning any prior valid and lawful order or booking of accommodation that you lawfully and validly placed in accordance with the applicable Terms and Conditions, termination of your account may involve (1) termination of your access to all services, (2) deletion of your passwords and related details, your Credentials, files and content linked to your account, and (3) a ban from using the Website in future.

Without prejudice to your obligations concerning prior valid and lawful order or accommodation booking that you lawfully and validly placed in accordance with the applicable Terms and Conditions, you may close your account at any time, subject to your acceptance that Vacancéole Voyages may be required to save and store, for a certain time after closure of your account, information such as your password and related information, your Credentials, files and content linked to your account for legal, tax, administrative purposes or in order for Vacancéole Voyages to meet some other requirement under applicable law, rules and/or regulations.

14.3 Survival of terms

All restrictions regarding all Website Content (or downloaded from the website), disclaimers and limitations of liability and indemnification obligation shall survive the termination hereof.

15. International use

Vacancéole Voyages makes no claim as to the appropriateness or availability of the Website Content (or any Service, Products or Accommodation available thereon) for use in regions outside Countries covered by the Service. It is strictly prohibited to access the Website from territories in which the Website Content is illegal. Persons who opt to access the Website from regions outside Countries covered by the Service do so at their own risk and at their sole discretion, and are responsible for complying with the applicable laws, rules and regulations in that region.

16. Divisibility

Should one or more provisions be deemed invalid, illegal or unenforceable in any way by a relevant authority, they shall be considered separate from the remaining clauses, which shall retain their full legal effect.

17. Dispute resolution procedure

In the event of a dispute, the parties shall have the chance to resolve the matter amicably. If no amicable settlement can be reached, the dispute shall then be referred to the court with jurisdiction over the location of Vacancéole Voyages head office.

18. General provisions

Failure to enforce any of these Terms and Conditions shall not be understood as an additional or permanent waiver of that or any other provision, and the fact that Vacancéole Voyages does not exercise any right or clause under these Terms and Conditions shall not constitute a waiver of said right or clause. Unless stated otherwise, these Terms and Conditions shall constitute the entirety of the agreement between Vacancéole Voyages and you in respect of your use of the Website and Products, and annuls and supersedes all prior or existing communications or offers (written, verbal or electronic) between Vacancéole Voyages and you in respect of matters addressed herein.

Should any one of these Terms and Conditions be ruled invalid, void or unenforceable for any reason, the condition shall be considered divisible and shall not affect the validity and binding character of the other terms and conditions.

You may not transfer or assign these Terms and Conditions or any rights and/or licences granted hereunder, but Vacancéole Voyages may transfer or assign them without restriction, provided that the transfer or assignment of rights and obligations concerning you under these Terms and Conditions remain unchanged.
